Abstract

This paper analyzes the relationship between the legal system and the guarantees of dignity for women and for diverse gender identities and sexual orientations within the scope of Working Group 3 (WG 3) – Law, Gender, and Sexualities. Using the ethics of care as its guiding framework, the study examines three thematic axes: the legal protection of vulnerable populations, reproductive rights and the response of justice institutions to gender-based violence, and the cross-cutting role of law in promoting the citizenship of historically marginalized bodies. A qualitative bibliographic and documentary approach is adopted, drawing on critical legal theory, gender studies, and constitutional hermeneutics. It is argued that the ethics of care, far from being confined to the private sphere, constitutes a guiding principle for public policies and for a constitutionally grounded interpretation committed to substantive equality. The study concludes that addressing the multiple forms of violence that affect bodies requires the articulation of robust normative frameworks, the training of institutional actors who are sensitive to the intersectionality of gender and race, and the recognition of the political agency of vulnerable subjects as an indispensable condition for the effective realization of fundamental rights.

Jonatas de Melo Alves, Unifavip wyden

Law student, researcher, and academic leader. He currently serves as President of the Academic League of Justice and Law (LAJUDI), where he coordinates academic, scientific, and extension projects focused on legal education, citizenship, and access to justice.

He has experience in public administration and institutional management, contributing to projects related to public service modernization, human resource management, and organizational development. He is actively engaged in academic research, scientific writing, and the organization of scholarly events.

His research interests include Criminal Law, Criminal Procedure, Constitutional Law, Human Rights, Critical Legal Theory, and Public Policy. His academic work adopts a critical and guarantee-based approach, examining the role of legal institutions in promoting human dignity, social inclusion, and democratic values.

His current research focuses on criminal justice reform, restorative justice, prison policies, the protection of vulnerable groups, and the intersections between law, ethics of care, citizenship, and social inclusion.
