Abstract

This deductive study, situated within criminal law dogmatics, aims to define the theoretical framework of the mental element of international crimes, with a specific focus on the International Criminal Court (ICC). To this end, documentary analysis of the Rome Statute and ICC merit judgments was conducted, alongside a comprehensive literature review. Initially, foundational concepts of the Romano-Germanic (civil law) and Anglo-Saxon (common law) models are outlined: culpability, dolus (intent), and guilt (negligence), which are characteristic of the Germanic-influenced theory of crime; and mens rea, characteristic of common law systems and international criminal law, both of which feature a less refined systematization. Subsequently, the positive prerequisites of the mental element as provided for in the Rome Statute are analyzed, as well as their interpretation in the ICC's merits precedents. Finally, the defenses provided for in the Statute relating to the mental element are examined, along with how they have been interpreted by the Court. The study concludes by advocating for an integrated reading of international criminal law and domestic criminal law, drawing upon relevant theoretical contributions to achieve a more appropriate and secure definition of the subjective element.
